Access to and use of the PLATFORM implies express acceptance of these TERMS AND CONDITIONS, the Privacy Policy, and any other applicable legal documents governing the use of the services provided.
PARTIES TO THE AGREEMENT
2.1. Users: Natural or legal persons who meet the registration requirements and use the services offered by ATLANTIC EXCHANGES SPA.
2.2. ATLANTIC EXCHANGES SPA: A legally registered entity in CHILE, operating as a provider of cryptocurrency exchange services and international money transfer services, and the owner of the platform.USER REGISTRATION AND VERIFICATION (KYC)
All Users must register and complete verification processes to access the services. Two levels are established:
3.1 Basic Registration: Requires full name, country of residence, email address, and password creation. Grants limited access to the PLATFORM.
3.2 Advanced Registration: Includes KYC verification with official documents (ID, NIE, or Passport), a selfie with the document, proof of residence, occupation, and monthly income. Only upon completing this level will access to the company’s financial services be granted.
ATLANTIC EXCHANGES SPA may request additional documentation, video call validations, or proof of ownership of wallets or bank accounts at any time.
SERVICES OFFERED
ATLANTIC EXCHANGES SPA acts as an intermediary for:
Buying and selling cryptocurrencies (primarily USDT) through regulated platforms.
Transfers between wallets and conversion from digital currencies to fiat.
Remittance transfers from Chile and Europe to countries like Venezuela, Peru, and other Latin American countries.
Funds are received into safeguard accounts or wallets controlled by the company and settled according to the user’s instructions, strictly complying with anti-money laundering regulations.
OPERATIONAL FLOW AND EXECUTION OF TRANSFERS
5.1 Initiation: The user accesses their account or service channel (WhatsApp enabled), selects “New Transfer,” and completes the order details: destination country, beneficiary information, exchange rate, payment method, destination wallet or account, etc.
5.2 Payment Phase: The user transfers funds via:
Bank transfer from their personal account in pesos or euros.
Cryptocurrency transfer from their own wallet.
Card payment (for verified users, subject to policy and availability).
Funds will be verified before the order is executed.
5.3 Confirmation: Once the funds and documentation are validated, the currency exchange and credit to the beneficiary are executed.
FEES AND EXCHANGE RATE
Registration on the PLATFORM is free. Transactions are subject to:
Service fees ranging from 8% to 13% of the transferred amount.
Competitive exchange rate, shown before confirming the order.
A 10% penalty for unjustified cancellations.
The beneficiary will receive the net amount after all applicable charges.
ORDER IRREVOCABILITY AND REJECTION POLICY
An order cannot be canceled once confirmed, except in cases of force majeure or justified cause. ATLANTIC EXCHANGES SPA may reject suspicious operations or those with incomplete information.
MAXIMUM EXECUTION TIME
Transactions will be executed as quickly as possible. For operations involving wallets or commonly used fiat currencies (e.g., USD, PESOS, or VES), the average execution time is under 30 minutes, barring technical issues or additional verification.
LIABILITY OF THE PARTIES
The User is responsible for the accuracy of the information provided, especially the beneficiary’s wallet or account. ATLANTIC EXCHANGES SPA is only liable for errors arising from its internal processes. In case of loss due to user error, no reimbursement will be made.
DISCLAIMER OF LIABILITY
ATLANTIC EXCHANGES SPA is not responsible for failures caused by intermediary banks, blockchain network congestion, force majeure, cyberattacks, or third-party omissions.
APPLICABLE REGULATIONS AND AML/KYC COMPLIANCE
The company complies with Spanish and European data protection and anti-money laundering regulations. All onboarding and monitoring processes adhere to GDPR, LOPDGDD, and Law 10/2010. Additionally, the company complies with Chilean legislation, including the Anti-Money Laundering Manual aligned with Law No. 19.913 (UAF), Law No. 21.521 (Fintech Law), and Law No. 18.045 on the Securities Market, and KYC requirements in Chile.
CONTRACT DURATION AND TERMINATION
This is an open-ended agreement. The user may cancel at any time. ATLANTIC EXCHANGES SPA may terminate the agreement with two months’ notice or in cases of fraudulent use.

WhatsApp is a complementary communication and processing channel. Use implies acceptance of WhatsApp’s terms and privacy policy. Its use is optional and revocable.
PLATFORM MODIFICATIONS
ATLANTIC EXCHANGES SPA may modify these terms, services, or platform features without prior notice, with relevant changes being duly notified.
JURISDICTION AND APPLICABLE LAW
This contract is governed by Chilean law. In case of dispute, the User may choose between the courts of their residence or those where the obligation is fulfilled.
